This document governs Medisave Health and Lifestyle Private Limited (“Company”, "us",

"we", or "our") access and operation of the Platforms. Please read these Terms and Conditions

("Terms") carefully before using Platform the http://www.medisavehealth.in (“Website”) and

Medisavehealth mobile application (“Application”) (hereinafter jointly referred to as

“Platforms”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with

these Terms.

About us: We bring together the entire value chain of offerings, by putting together expertise

from various disciplines of healthcare. Our team comprises of not only Industry veterans and

leaders, but a host of functional experts as well. The rich diversity of experience, age and

discipline allows us to develop a multi- dimensional approach, while maintaining unflinching

commitment to our cause. Our board itself is constituted from distinguished luminaries from

diverse backgrounds of Medicine, Insurance, Administrative Services, Defence and Corporate

Leaders. We offer a wide range of services including but not limited to Online Consultations and

E prescription, Booking Appointments for offline consultation, IPD/OPD, Various health care

and treatment packages, Home delivery of medicine, Sample collection facility at home, Online

reports, Online health history, E-Commerce platform for health care and pharmaceutical devices,

Cash back services.

Applicability: These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with

any part of the terms, then you may not access the Service.

Registration and Purchases: If you wish to make purchases of any the products listed on the

platform through our vendors or if you wish to avail any services from our Service Providers,

you may do so by registering yourself where you may be asked to supply certain information

relevant to your Purchase and Services availed including, without limitation, your Name, Contact

details, address and payment related information. You agree to provide authentic information for

the purpose of registration.

Subscriptions: Some parts of the Service are billed on a subscription basis ("Subscription(s)").

You will be billed in advance on a recurring. The Subscriptions section is for SaaS businesses.

Terms and Conditions of use:

i. These Terms shall be applicable to you who shall be customer of the Services

provided by the Vendors and Service Provider that shall be listed on the Platform. For

any other services directly availed by you through the Vendors and Service Providers

shall not be our concern and you waive your right to bring any concerns and

complaints regarding the same.

ii. You are further liable to produce your Membership Card and Membership details that

shall be provided by us upon your registration as member of our Platform. The

Service Providers and Vendors listed on our Platform are entitled to seek and verify

the membership details provided by you.

iii. You further undertake to provide us with the bank details and permissions to proceed

with the autorenewals of your subscription upon the execution of these Terms and

should you fail to auto renew or renew, we will undertake to withdraw your

membership and terminate your access to the membership of the Platform. For any

pending services, we will undertake to withdraw the same if you have not undertaken

to make the payment for the same.

iv. Note, that this membership acceptance is exclusive to you, and this cannot be

transferred to sublet to any person directly or indirectly and upon the receipt of any

information to us regarding the transferability by you, we will undertake to

immediately terminate your access to the Platform.

Term and Termination: These Terms shall be valid and binding on you from the date of your

acceptance and until your termination of the Services of the Platform. We may terminate these

Terms and your access to Platform at any given time if you are illegally and unlawfully

transacting through the Platform or upon the receipt of your incorrect information.

Limitation of Liability: We are not responsible for any consequences arising out due to an

inoperative/non-responsive Platform or due to any connectivity errors associated with the

internet connection such as but not limited to slow connectivity, no connectivity, server failure

which may lead to your access to our Services disrupted in any manner. Further, we will not be

liable if there is an undue delay or inability to communicate through email due to any Force

Majeure event or if there is a failure in the functioning of any of our Vendors or Service

Providers listed on our Platform. We accept no liability for any errors or omissions, on behalf of

itself, or for any damage caused to you, your belongings, or any third party, resulting from the

use or misuse of the website or any service availed of by us through the Platform. The service

and any content or material displayed on the service is provided without any guarantees,

conditions, or warranties as to its accuracy, suitability, completeness, or reliability. We will not

be liable to you for the unavailability or failure of the Platform.

Further, you agree to comply with all laws applicable to you or your activities, and with all

policies, which are hereby incorporated into this Terms by reference. We expressly exclude any

liability for any loss or damage that was not reasonably foreseeable by us, and which is incurred

by you in connection with the Platform, including loss of profits; and any loss or damage

incurred by you as a result of your breach of these Terms. To the fullest extent permitted by

law, we shall not be liable to you or any other party for any loss or damage, regardless of the

form of action or basis of any claim. You acknowledge and agree that your sole and exclusive

remedy for any dispute with us is to terminate your use of the Platform.

Amendments: We reserve the right, at our sole discretion, to modify or replace these Terms at

any time. If a revision is material, we may try to provide at least 30 (change this) days' notices

prior to any new terms taking effect. What constitutes a material change will be determined at

our sole discretion.

Entire Agreement: These Terms form the complete and final contract between us with respect

to the subject matter hereof and supersedes all other communications, representations, and

agreements (whether oral, written or otherwise) relating thereto.

Waiver: The failure at any time to require performance of any provision of these Terms shall in

no manner affect our right at a later time to enforce the same. No waiver by us of any breach of

these Terms, whether by conduct or otherwise, in any one or more instances, shall be deemed to

be or construed as a further or continuing waiver of any such breach, or a waiver of any other

breach of these Terms.

Severability: If any clause of these Terms is held to be invalid, illegal, or unenforceable by

any court or authority of competent jurisdiction, the validity, legality, and enforceability of

the remaining provisions/clauses of these Terms shall in no way be affected or impaired

thereby, and each such provision/clause of these Terms shall be valid and enforceable to the

fullest extent permitted by law. In such case, these Terms shall be reformed to the minimum

extent necessary to correct any invalidity, illegality, or unenforceability, while preserving to

the maximum extent to our original rights and intentions hereto.

Jurisdiction: All disputes that may arise through your acceptance of these Terms shall be

governed under the laws of India and the Courts in Bangalore; Karnataka shall have the

exclusive jurisdiction to try any such disputes that may arise.
